Patents and patent pools may serve several purposes. An examination of Tesla’s open-source/license free pool, particularly when we compare it to the patent pools/licensing schemes of Tesla’s more established competitors, Toyota and Ford, illuminates several possible reasons and goals behind each company’s strategy.
Specification and Claim Drafting to Avoid Indefiniteness
Beginning with a discussion of the Supreme Court decision in Nautilis v. Biosig Instruments as background this presentation will then review more recent Federal Circuit decisions post-Nautilis involving chemical patents. Next will be practice tips for specification and claim drafting in view of Nautilis and its progeny to avoid potential indefiniteness pitfalls during prosecution and when trying to enforce issued patents.
