­Mr. Sozzani litigates matte­rs at the trial and appellate levels involving patents, trademarks, copyrights, trade secrets, trade dress, false advertising, rights of publicity, unfair competition and other intellectual property and technology matters in State and Federal Courts for both plaintiffs and defendants.  Mr. Sozzani also advises and represents clients in planning, negotiating and executing transactions involving intellectual property rights including matters relating to the analysis, evaluation, licensing, protection, procurement and transfer of intellectual property rights.  He has represented both U.S. and multinational clients, including numerous Fortune 100 companies, in high stakes intellectual property litigation and transactional matters. 

Mr. Sozzani is admitted to practice in Florida, New York and New Jersey.  He has litigated matters in Federal District Courts across the United States including the Eastern District of Texas and Middle District of Florida.  Mr. Sozzani has represented clients in matters involving banking, business methods, digital storage, e-commerce, electronic trading platforms, food processing, high-powered fiber optic lasers, high-speed industrial molding machines, automated intelligent lighting, commercial and residential lighting, laminate flooring, medical devices, mobile telecommunications, payment cards and loan systems, pharmaceuticals, plastics, software, silicon chips and consumer products.  He has also authored numerous articles relating to federal litigation and practice, trademark and patent law including articles published in the National Law Journal, New York Law Journal and Journal of Technology Law and Policy.  Mr. Sozzani also served on the Amicus Committee for the New York Intellectual Property Law Association where he assisted in the drafting of amicus submissions to the U.S. Supreme Court and U.S. Court of Appeals for the Federal Circuit.

Previously, Mr. Sozzani served as General Counsel for a Private Equity Investment Company, a Patent Litigation Associate at the New York office of Skadden, Arps, Slate, Meagher & Flom, LLP and an Intern at the United Nations World Intellectual Property Organization (WIPO) in New York City.  Mr. Sozzani has also engaged in substantial pro bono practice, including the representation of not-for-profit corporations as well as work for the Innocence Project.

  • Co-Lead Counsel in a U.S. District Court, Eastern District of Texas, patent infringement matter representing defendant, a leading income tax preparation company, addressing issues of first impression relating to patent claims directed to computer implemented financial products and payment systems; spearheaded prior art search, achieved favorable claim construction, conducted and defended all depositions and drafted dispositive motions resulting in a finding of invalidity in two of three business method patents-in-suit, resulting in settlement.

  • Held a key role on trial team in a U.S. District Court, Eastern District of Texas, patent infringement jury trial against a nonpracticing entity (NPE), in representation of co-defendants, one of the largestU.S. banks and the largest national archives of check images and electronic content for multi-bank infrastructure solutions, resulting in a finding of noninfringement.

  • Led expansive due diligence project in the acquisition of a large patent portfolio consisting of 880 patents in a $2.2 billion merger and acquisition of a leading global software, cloud computing, mobile device application and system developer’s patent portfolio by a consortium including Apple, Microsoft, EMC and Oracle.

  • Led, trained and orchestrated the efforts of a large scale litigation review team of over 60 attorneys in an extensive prior art search which resulted in the successful defense of a patent infringement matter and a finding of invalidity on summary judgment in U.S. District Court, Eastern District of Texas.

  • Represented major international pharmaceutical company in Paragraph IV, Hatch-Waxman Act, Abbreviated New Drug Application (ANDA) litigation.

  • In a U.S. District Court, Middle District of Florida, Co-Lead Trial Counsel for leading commercial and residential lighting manufacturer and online retailer in a pending complex intellectual property litigation matter involving patent, trademark, copyright, unfair competition, false advertising and reverse passing off.

  • In a U.S. District Court, Middle District of Florida, Co-Lead Trial Counsel for manufacturer and retailer of firearm accessories in pending patent infringement and unfair competition litigation.

  • In a U.S. District Court, Southern District of New York, represented a leading global enterprise software development company, performed extensive legal research and trial preparation in the successful defense of copyright infringement and trade secrets misappropriation actions.

  • In a U.S. District Court, District of Massachusetts, patent infringement matter represented defendants, two leading medical device manufacturers, with regard to asserted claims relating to the mechanical design of a blood centrifuge device.

  • Negotiated and drafted trademark license agreements as between two major movie production companies and celebrity client in purchase and use of the original Batmobile utilized in the debut blockbuster motion picture production.

  • Negotiated and drafted sophisticated licensing agreements relating to trademarks, persona rights, royalties and merchandising for the launch and development of an internationally recognized celebrity themed restaurant and entertainment venue.

  • Negotiated and drafted complex cross-licensing patent agreements in settlement of pre-litigation and litigation matters involving complex optical devices and digital communication systems for the world’s leading manufacturer of intelligent lighting products.

  • Led negotiation of terms and conditions, drafted final agreement of a purchase and sale agreement with two worldwide entertainment and media companies and a third party trademark licensee in high-level transactional matter.

  • Represented defendant mobile device manufacturer in multiple patent infringement litigation and licensing matters.

  • Represented top five investment fund, completing due diligencerelating to the acquisition of a patent portfolio covering transaction-specific Dynamic Authentication Code (DAC) and contactless payment card technologies.

  • Conducted risk analysis, determined potential exposure, freedom to operate, reasonable royalty rates and competitive landscape for leading international silicon wafer microchip manufacturer in anticipation of licensing and merger negotiations.

  • Played a key role in the representation of a leading multinational information technology corporation in negotiating the favorable settlement of patent infringement litigation relating to wireless technology standards.

  • Played a key role in assisting lead trial counsel in a U.S. District Court, Eastern District of Texas, breach of contract litigation stemming from a patent litigation settlement, ultimately resulting in entry of $69 million judgment in favor of plaintiff, a leading financial institution.

  • Assisted in consultation of corporation launching new gTLD regarding privacy and regulatory issues.
