John K. Lucas

John Lucas' career has encompassed patent, trademark and copyright cases. For more than 40 years, his work has helped shape laws and enforce important intellectual property rights.

In addition to his work as a litigator, John has counseled clients on patent procurement strategies and licensing agreements. He has worked with clients in numerous disciplines including electronic, electro-mechanical and mechanical systems, and food technology.

John has served as an adjunct professor of patent law at DePaul University. A longtime leader at Brinks, Gilson & Lione, John helped guide the firm’s growth by serving as its in-house General Counsel.

Experience | Overview
  • Intermatic, Inc. v. Toeppen—Broke new ground in the first case ever to apply the doctrine of dilution in the trademark context, representing the owner of federally registered trademark in a suit against a cybersquatter. In its landmark decision, the Court permanently enjoined the defendant from infringing the trademark and from asserting further interest in an Internet domain name.
  • Intermatic, Inc. v. Lamson & Sessions—Won a jury verdict for the patent owner in a suit alleging willful infringement of its a patent on weatherproof outlet covers.
  • Intermatic Incorporated v. Chardonnay Corp—Won a jury verdict of willful patent infringement for the owner of a patent on an electronic remote control system  
  • Peyton v. Fishhawk Electronics—Won a jury verdict of patent infringement in favor of for the owner of a patent covering fishing electronics.
  • Has represented numerous pro bono clients in Chicago housing cases.

  • Aliant Communications Inc. v. Interstate Energy Corp. Represented Interstate Energy in a trademark infringement action. The case was settled after a temporary restraining order hearing and a preliminary injunction hearing.
  • Bacus Laboratories, Inc. v. MicroBrightField, Inc. Patent infringement action involving virtual microscopy imaging software.
  • Regent Lighting Corporation v. BWF/M, Stephens Manufacturing, Inc. Design patent infringement action on a halogen light fixture.
  • Dometic Corporation v. Intertherm, Inc. Patent infringement action relating to an RV air conditioner.
  • Docu-Vision, Inc. v. Court Technologies, Inc. Preliminary injunction proceedings. Patent involved video conferencing system for courtrooms.
  • Budd Company v. Complax. Patent infringement action relating to plastic molded automobile parts.
