Bill Frankel discusses Authors Guild v. Google on Legal Talk Network Podcast
On November 11, 2015, Brinks Gilson & Lione shareholder William H. Frankel who chairs the firm’s Copyright Practice Group, participated in an online panel discussion on LegalTalkNetwork of the recent unanimous decision of the U.S. Court of Appeals for the Second Circuit, upholding a lower court’s ruling in Authors Guild v. Google.
In this widely followed copyright infringement case, which pit the authors of original works and their publishers against the web search giant and which has now lasted a decade, the Second Circuit held that Google’s digitizing of books to create a search functionality and its display of snippets from those works are non-infringing fair uses owing to their highly transformative nature and the ensuing public benefit of providing access to these works.
Frankel joined two other copyright attorneys in a discussion of the case, which may still be appealed to the U.S. Supreme Court. An edited version was distributed to LegalTalkNetwork’s subscribers late last week.
