Bradley G. Lane and Janet A. Pioli to Present at the ACI Medical Device Patents Conference

On March 5, Bradley G. Lane and Janet A. Pioli will be speakers at the upcoming ACI Medical Device Patents conference in Chicago, IL.

Mr. Lane will be moderating, “Preparing Your Device Portfolio for Litigation: Limiting Liability and Managing and Reducing Costs.” The session will cover:

  • Weighing the benefits of quasi-litigation in the PTO versus litigation in the courts
  • Selecting a venue, influencing the timing of a Markman hearing, and taking a realistic approach to discovery
  • Avoiding common pitfalls when working with experts
  • Considering the Hatch-Waxman safe harbor exemption for medical devices, including its applicability to activities after FDA approval

Ms. Pioli will be discussing on the panel, “Is Inequitable Conduct Dead? Updating Medical Device Prosecution and Litigation Strategies Post-Therasense.” The session will cover:

  • Showing the threshold of intent to deceive
  • Examining the tightening of the inequitable conduct standard in Therasense and its progeny
  • Best practices going forward
